Ikeja and Eko electricity distribution companies have been summoned to appear in an Ikeja High Court over their failure to implement the Order, capping the estimated billing of some of their customers.

The suit filed by the All Electricity Consumers Protection Forum (AECPF) is to be heard before Justice Lateef Lawal-Akapo. The claimant alleged that the defendants failed to comply with the Nigerian Electricity Regulatory Commission (NERC) Order (NO/NERC/197/2020) on the capping of unmetered Residential (R2) and Commercial (C1) electricity customers.

The group claimed both DisCos failed to comply with the capping Order for ten months from February 2020 to November 2020. Accordingly, the claimant asked the court to determine whether it was within the power of DisCos to disobey the directives of NERC under section 63(1) of the Electric Power Sector Reform Act 2005.

The group has asked the court to declare that the act of the first and second defendants’ violation of the capping method was unlawful. It also asked for an order directing the defendants to refund the consumers affected by wrongful billing for ten months under a repealed estimation billing instead of capping. The claimant further demanded payment of ₦500,000 from the defendant for the cost of the suit.
